These Terms of Service ("Terms") govern your use of Glass, a social media publishing and scheduling platform ("Glass," the "Service") operated by Unrivaled Marketing Solutions LLC ("Unrivaled," "we," "us," or "our"). Glass lets our team and our clients connect their own social media accounts and publish, schedule, and manage their own content across those accounts. By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What Glass is

Glass is a tool for publishing and scheduling social media content. Authorized users connect social media accounts they own or are permitted to manage, and use Glass to compose, schedule, publish, and review posts on those accounts. Glass acts on your behalf, at your direction, only on the accounts you connect.

2. Who may use the Service

You must be at least 18 years old and authorized to enter into these Terms, whether on your own behalf or on behalf of a brand, client, or organization. If you use Glass for an organization, you represent that you have authority to bind it to these Terms.

3. Connecting accounts and your responsibilities

  • You may connect only accounts you own or are authorized to manage. You are responsible for having the rights and permissions to publish the content you post through Glass.
  • You are responsible for the content you schedule and publish, and for complying with the terms, policies, and community guidelines of each connected platform (for example, TikTok, Instagram, YouTube, Facebook, LinkedIn).
  • You authorize Glass to access and act on your connected accounts to perform the actions you request (publishing, scheduling, retrieving basic account and post information).
  • You are responsible for maintaining the security of your Glass access and for activity conducted through it.

4. Third-party platforms

Glass connects to third-party platforms through their official APIs. Your use of each connected platform remains subject to that platform's own terms and policies. We are not responsible for changes to, or the availability of, third-party platforms or their APIs, and a platform may limit, suspend, or revoke API access at any time.

5. Acceptable use

You agree not to use Glass to: violate any law or any connected platform's rules; publish content you lack the rights to; post spam, deceptive, infringing, or harmful content; attempt automated abuse, manipulation of platform metrics, or circumvention of platform limits; or interfere with the Service's operation or security.

6. Content ownership

You retain ownership of the content you publish through Glass. You grant us only the limited permission needed to store, process, and transmit that content to the connected platforms to provide the Service. We claim no ownership of your content or your accounts.

7. Intellectual property

The Glass software, interface, and branding are owned by Unrivaled Marketing Solutions LLC and its licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service as intended. Nothing here transfers ownership of the Service to you.

8. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that posts will always publish successfully, since publishing depends on third-party platforms outside our control.

9. Limitation of liability

To the fullest extent permitted by law, Unrivaled Marketing Solutions LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, revenue, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed one hundred U.S. dollars (US $100).

10. Suspension, changes, and termination

We may modify, suspend, or discontinue the Service, or your access to it, at any time. We may modify these Terms; when we do, we will update the "Last updated" date. Continued use after changes take effect means you accept the revised Terms.

11. Governing law and contact

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules, and any dispute will be resolved in the state or federal courts located in Texas.
